Recording Fee Surcharge Increase

Posted on August 23, 2011 by joannwood

If you have recorded any documents in Land Records since July 1, 2011, you may have noticed an increase in the costs to record.  The Budget Reconciliation and Financing Act of 2011 amended the Courts and Judicial Proceeding Article §13-604 to increase the surcharge on all recordable instruments from $20.00 to $40.00.  This means the recording fee on a deed on a principal residence is now $60.00.  The recording fee on a mortgage for a principal residence is now $60.00.  Both used to be $40.00.  These are a few examples of the results of this change in the law.
